Enforcement Guidance for Second National Lockdown

Following the implementation of national restrictions in England, set to last until 2nd December, the Ministry of Justice has issued guidance relating to the enforcement of writs of control and writs of possession during lockdown.
Our officers will be able to continue enforcement visits to residential and commercial premises - as long COVID-secure guidance is followed. They should not, however, enter residential properties for the purpose of enforcement by taking control of goods.
The Ministry of Justice has also clarified exemptions for circumstances in which evictions at residential premises can take part. These include:
- Illegal trespass or squatting by persons unknown
- Nuisance or antisocial behaviour
- Domestic abuse
- Fraud or deception
- Properties unoccupied following the death of the defendant
The Lord Chancellor also intends to allow evictions for “extreme” levels of pre-COVID rent arrears.
